This is an Application through jail. The Applicant has prayed that he may be allowed to submit cash bail in lieu of sureties as he is unable to get any sureties. He has further stated that though he was directed to be released on bail on 28th January 2015, because of the fact that he was unable to furnish one or two sureties in the amount directed by the Trial Court, he is still languishing in jail. 2.

Heard the learned APP. The learned APP submits that taking into consideration the fact that the order granting bail to the Applicant was passed on 28th January 2015, appropriate orders in the interest of justice may be passed.

I have perused the order dated 28th January 2015. While releasing the applicant on bail, the Special Judge, Greater Mumbai has imposed a condition that the Applicant shall be released on bail on his furnishing PR Bond of Rs.30,000/- alongwith one or two sureties in the like amount.

After taking into consideration the facts and circumstances of the present Application, I am inclined to allow the Applicant to furnish the cash bail for a period of eight weeks till he secures one or two sureties in the like amount as was directed by the Trial Court. Hence the following order.

The applicant is permitted to submit cash bail of Rs.30,000/- for a period of eight weeks.

After the applicant is released on bail, the applicant has to furnish one or two sureties in the like amount within a period of eight weeks thereafter.

The other conditions imposed by the Trial Court by its order dated 28th January 2015 are not disturbed. The Application is allowed in the aforesaid terms.

The Registry is hereby directed to communicate this order to the Applicant who is in Arthur Road Jail, Mumbai. (A.S. GADKARI, J) VRD
