Heard learned counsel appearing for the parties. Admittedly while passing the impugned order, the petitioner was not heard. In that view of the matter, the impugned order is passed in breach of the principles of natural justice. In the result, the impugned order is quashed and set aside. Application No. PSD/NOC/SR/35/2017 is restored to its original file.

The collector/Additional collector shall hear the parties and decide the application afresh filed by the respondent. 3.

The learned collector/Additional Collector shall consider the application on its own merits and thereafter pass an appropriate orders after affording reasonable opportunity of hearing to all concerned.

With the above observations, petition stands disposed of. 5.

The parties to act on the authenticated copy of this order. 6.

The parties to appear before the learned Collector/Additional Collector, Pune on 15th April,2019.

The Collector/Additional Collector, Pune shall decide the said application as expeditiously as possible however within two months from 15th April,2019.
