After having heard Mr. V. Sridharan, learned Senior Counsel appearing for the Petitioner, and Mr. V.A. Sonpal, learned Special Counsel appearing for the Respondent-State, we dispose of this Writ Petition in the presence of the Joint Commissioner of Sales Tax, VAT Administration, Raigad Division. The said Officer states that the order impugned in this Writ Petition, copy of which is at Annexure-A, Page Nos. 23, 25 and 27 of the paper-book, stands withdrawn. The statement is accepted. Once the attachment is raised, then, nothing needs to be observed in so far as the merits are concerned. By clarifying that we have not expressed any 1/2 WP-8045-16.doc

opinion on the rival contentions in so far as merits is concerned, we dispose of this Petition on the statement made by Mr. Sonpal. 2.

Mr. Sonpal states that the Assessment Officer will complete the assessment in the case of the Petitioner within three months from today; however, the Petitioner should co-operate by attending the hearings and producing all the relevant documents and records. Mr. Sridharan, on instructions, states that the Petitioner would attend all the hearings and not seek unnecessary adjournments. It will co-operate in disposal of the assessment proceedings within a period of three months. 3.

The Writ Petition is disposed of in the above terms. 4.
