Because of the conflict in what has been seen in the Record and Proceedings and what has been categorically observed by the Magistrate in his judgment, and in view of the order dated 18th November 2015, a deeper probe into the matter is necessary. The Record and Proceedings have been received pursuant to the said order.

In the circumstances, it would be proper to grant leave to appeal, and decide the Appeal expeditiously. Hence, Leave is granted.
