This is an application under section 438 of Cr.P.C.. The applicants herein are apprehending their arrest in Crime No.167 of 2016, registered at Tembhurni Police Station, for the offence
punishable under sections 392, 504, 506 r/w 34 of the Indian Penal Code.

It is the case of the prosecution that on 14th April 2018, Umesh Mete lodged the report at the police station alleging therein that on 12th April 2018, when his father and his brotherin-law Nitin Devkar were travelling in their Bolero Jeep with Rs.4,00,000/-, the present applicants had followed them and accosted them. They were forced to alight from the vehicle and thereafter they had taken away the vehicle. It appears from the papers of investigation that the applicants had entered into an agreement to purchase land from Haridas Mete. The present applicants had informed the first informant that they do not wish to purchase the said land upon which they were demanding the said amount. It appears that there is a dispute of civil nature. The informant had taken money towards sale of the said land and had not returned the same.
Learned counsel for the applicants upon instructions submits that the Bolero Jeep is in possession of the first informant. In view of the nature of allegations as revealed in the papers of the investigation, the applicants have made out the case for grant of pre-arrest bail.
ORDER
i) The Applications are allowed.
ii) In the event of their arrest, the applicants be enlarged on bail on furnishing PR bond in a sum of Rs.50,000/- each with one or more solvent sureties in the like amount.
iii) The applicants shall report to the concerned police station from 2nd July 2018 to 7th July 2018, every day between 10.00 a.m. to 1.00 p.m. and co-operate the Investigating Officer. iv) The applications are allowed and disposed of in above terms. ( SMT.SADHANA S.JADHAV, J. )
