1] Learned counsel who appears for the applicant i.e. Bombay Mercantile Co-op. Bank Ltd., states that he has already issued a notice to the applicant that he would be seeking discharge in the matter. He states that such notice has been duly received by the applicant.
2] The ad interim order, of which, modification is applied for by the applicant was made on 7 July 2015. In these circumstances, it is not possible to simply adjourn the matter.
3] Accordingly this civil application is dismissed for non prosecution.
