This Civil Application is taken out for condonation of delay of one year and 27 days in filing the Second Appeal. 2.

Heard Mr. Gaikwad, learned counsel appearing for the Applicant and Mr. Sonawane, learned counsel appearing for the Respondent. Mr. Sonawane very strongly opposes the application. However, there is no reply filed to the delay condonation application. Therefore, the contentions raised in delay condonation application have remained un-controverted.

For the reasons set out in the Interim Application, the same is allowed in terms of prayer clause (a). However, delay is condoned on the condition that Applicant pays cost of Rs.3,000/- to the Respondent.
