Heard learned Counsel for the parties.

By this application, the Applicant seeks modification/relaxation of the condition set out in clause 2(I) of para 4, imposed by the learned Additional Session Judge, City Civil Court, Greater Bombay, vide order dated 17th October, 2018, passed in Bail Application No.1991 of 2018.

The condition of which modification/relaxation is sought, reads thus:-

(I) The applicant shall attend the concerned police station on every Sunday from 12.00 p.m. to 3.00 p.m. till filing of charge-sheet and also as and when called by investigating officer by written intimation." 4.

Learned Counsel for the applicant states that the applicant has been attending the concerned police station as directed on every Sunday for about one year. He submits that the applicant has filed a petition seeking quashing of the case, pursuant to which, an order has been passed by the Division Bench of this Court, not to be file charge-sheet, as against the applicant. He submits that in view of the said order, the police are unable to file the charge-sheet.

Learned APP does not dispute the same.

Having regard to what is stated aforesaid, the application is allowed and the condition set out in clause 2(I) of para 4, imposed by the learned Additional Session Judge, City Civil Court, Greater Bombay, vide order dated 17th October, 2018, passed in Bail Application No.1991 of 2018, stands modified.

Accordingly, the applicant shall now attend the concerned police station, as and when called. Rest of the order dated 17th October, 2018, to remain as it is.

The Application is allowed and disposed of in above terms. 9.
