1) The learned APP on instructions from the Investigating Officer who is present in the Court submitted that the applicant (accused No.4) who was arraigned as accused in CR No.168 of 2016 registered with Sahu Nagar Police Station expired on 25.7.2016 while he was in the jail custody. The learned APP tendered a report submitted by the Police Station of Sahu Nagar dated 16.8.2016 in that behalf along with death certificate of the applicantKishore G. Wakode. In view of the above, the present case as against the applicant stands abated.

2) In view of the above, the application has became infructuous and is accordingly disposed off.
