By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicants seek transfer of the proceedings being S.C. Suit No.83 of 2016 filed by the Respondent No.1 before the City Civil Court, Mumbai to the Court of Civil Judge Junior Division at Roha and for directions that the same be heard and tried alongwith Regular Civil Suit No.39 of 2014. 2.
Perused the above Miscellaneous Civil Application. The contesting Respondents i.e. Respondent Nos.1 to 11 have not filed any reply opposing the said transfer. In view thereof, for the reasons set out in the above Miscellaneous Civil Application, the proceedings being S.C. Suit No.83 of 2016 filed by the Respondent Nos.1 to 11 before the City Civil Court, Mumbai is directed to be transferred to the Court of Civil Judge Junior Division at Roha for being heard and disposed off
