Learned APP submitted that in respect of subject crime, 'C' Summary Report has been filed. Petitioner's grievance is that pending petition, police has made haste in filing 'C' Summary Report which speaks for itself.

However, in view of filing of 'C' Summary Report, the petitioner is at

2/2 21wp2393.16.sxw liberty to contest the same before J.M.F.C. Court No.4, Shivaji Nagar, Pune.

We direct that in case the petitioner files protest petition against 'C' Summary Report, the concerned Court shall take appropriate steps in accordance with law and dispose of the matter on its own merits at the earliest.

With aforesaid observations and directions, Petition stands disposed of.

In view of disposal of petition, criminal application does not survive and is disposed of accordingly.
