The Petitioners are seeking a direction to Respondent No.4the Co-operative Registrar and Commissioner for the Co-operative Societies to decide references made by the Petitioners for referring the dispute to the arbitration and appointment of Arbitrator as per Section 84 of the Multi State Co-operative Societies Act, 2002.

The writ petition was filed on 19 June 2019 and the same has remained pending. Dispute that the Petitioners sought to refer to arbitration was for declaration of disqualification of the Directors and that they be disqualified to contest ensuing election in 2018/2019.

Perusal of the dispute would show that concern of the Petitioners was that the Respondents/ Directors be prevented from contesting the elections which were then due in 2018/2019. The learned Counsel for Respondent No.5 and the learned Counsel for Respondent No.6 point out that by passage of time, the elections must have been held. Even the term of the elected body would have come to an end. Therefore, nothing survives in the writ petition. 4.
