At the beginning itself, learned APP pointed out that this Applicant has already withdrawn his ABA No.610 of 2023 on 1st March, 2023. The order is on Page No.174. It was allowed to be withdrawn. Considering the fact that the Applicant was appearing for 10th standard examination, time was granted to him to surrender on or before 26th March, 2023.

As learned Advocate for Applicant insisted that let the Court to hear this matter on merits, I have heard him, learned APP and learned Advocate for First-Informant. He made various contentions Satish Sangar 1/2
16-ABA-1824-2023.doc about certain averments in the FIR, copy of statement under Section 161 of the Code of Criminal Procedure, 1973 ["Cr.P.C."] and certain inconsistencies. After going through them, when this Court was not inclined to allow this Application, learned Advocate seeks liberty to withdraw it. Hence, it disposed of.
