Learned A.P.P, on instructions states that during pendency of the aforesaid application, charge-sheet has been filed against the applicant in the trial Court.

In view of the statement made by the learned A.P.P, learned Counsel for the applicant seeks leave to withdraw the application with liberty to file a fresh application in the trial Court after filing the chargesheet.

Accordingly, the application is disposed of as withdrawn with liberty to file a fresh application for bail after filing the charge-sheet. 4.
It is made clear, that this application has not been considered on merits and if an application for bail, after filing of the charge sheet is filed, the same shall be considered on its own merits, uninfluenced by the withdrawal of the aforesaid application.
