Pending application, the learned Additional Sessions Judge, Kalyan, vide order dated 17th April, 2019 had granted interim pre-arrest protection to the applicant. On 22nd June, 2021, application was dismissed for default.

The learned counsel for the applicant on instructions, submits that advocate for the applicant could not remain present before the Court since his father had expired.

Be that as it may, applicant's application for pre-arrest bail bearing No.653 of 2019 has not been decided on merits.

In the circumstances, let the applicant apply for restoration of his application no.653 of 2019. The learned Sessions Judge shall decide the restoration application and main application on its own merits preferably within four weeks from today.

Till then, interim pre-arrest protection granted to the applicant on 17th April, 2019 shall continue to operate.
