Record clearly indicates that, after completion of investigation of the present crime, the Investigating Officer has filed a final report under Section 173(2) of Code of Criminal Procedure in the Court of learned Metropolitan Magistrate, 26th Court, Borivali, Mumbai under Sections 420, 465, 468, 471, 472, 504, 506(2) read with 34 of Indian Penal Code.

In view thereof, substantive alternative remedy is available to the Petitioners by way of filing an application for discharge. 2.

Learned Advocate for the Petitioners therefore on instructions seeks leave to withdraw the present Petition with liberty to adopt substantive alternate remedy as may be available and 1/2
