When this petition is called out for hearing, specific question is put to the learned counsel for petitioner as to whether under which provision of the Arbitration & Conciliation Act, 1996 is the present petition filed, considering the fact that the impugned order is an order passed by the Court below, dismissing the application seeking restoration of Civil Miscellaneous Application under Section 34 of the said Act. 2.

Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file appropriate petition to challenge the said order, in accordance with law.
