Heard the learned counsel for the applicant.

This application is preferred by original claimant for fixing early date of hearing of First Appeal No.2172 of 2006.

The learned counsel for the applicant submits that connected First Appeal No.261 of 2007 and others arising from the same notification have already been finally decided by this court on 10.8.2012.

The learned counsel for the applicant submits that First Appeal No.1181 of 2005 to 1184 of 2005 arising from the same notification are also pending for hearing and final disposal. In similar way appeals filed by the State of Maharashtra and Mohite 1/2

14 caf2503-14.doc Cross Objections arising from the same notification are pending for hearing and final disposal. Same are stated in paragraph 7 and 8 of the Civil Application.

Considering the submissions made by the learned counsel for the Applicant and as no one appeared on behalf of State of Maharashtra, I am satisfied that the Applicant has made out a case for following order :

a) Office is directed to place First Appeals and Cross objections as stated in paragraph 7 and 8 of the Civil Application on board for orders on 1.2.2016 for fixing early date of hearing.
