The respondent, who is 72 years old, has filed a praecipe for early hearing of this appeal. Learned counsel for the appellant states that the paper book in the aforesaid appeal has not been filed so far by the appellant.

The appellant is directed to file private paper book i.e. photocopy of the proceedings before the lower appellate Court within six weeks from today, failing which Second Appeal No.1276 of 2005 to stand dismissed without reference to the Court. A copy of such paper book shall be served upon the learned advocate for the respondent simultaneously.
