By this application, the applicants seek quashing of the FIR registered vide C.R.No. 646 of 2019 with the Hinjewadi Police Station, Pune, for the alleged offences punishable under Sections 376(1), 376(2)(n), 377, 417, 323, 504, 506 of the Indian Penal Code and under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned APP, on instructions, submits that the police have filed an '

A' summary report in the said case, before the Special Court, Pune. She submits that after investigation, the police have concluded that there is no material as against the applicants and as such, have filed the said report. Learned APP has tendered a copy of the said report of ACP, Shrikant Disale, Wakad Division, Pimpri-Chinchvad, Pune, evidencing the same. The said report is taken on record. 3.

In view of the aforesaid, nothing survives for further consideration in the aforesaid application and hence, learned Counsel for the applicants seeks leave to withdraw the application. 4.

The application is accordingly disposed of as withdrawn. 5.

Liberty is however, granted to the applicants to file a fresh application/petition, if the occasion so arises. 6.

We make it clear, that we have not heard the petition on merits.
