The Petitioner has challenged the order dated 13th February 2019 directing the framing of charge passed by the Judicial Magistrate First Class, Court No.2, Solapur in R.C.C. No.204 of 2015.

Hence, this order can be challenged before the Court of Sessions, by way of Revision Application. Learned Counsel for the Petitioner seeks permission to withdraw this Petition. 3.

Considering these submissions, the Petition is allowed to be withdrawn with liberty to the Petitioner to approach the Court of Sessions, challenging the order impugned in this Petition. If any Ashwini V

15-WP-3214-2019 issue of condonation of delay is raised, the Revisional Court shall take into consideration the fact that the Petitioner was pursuing this Petition before this Court from the year 2019. Such Revision Application shall be decided in accordance with law. 4.

With these observations and liberty, the Writ Petition is disposed of.
