Learned APP, on instructions from in-charge Superintendent of Kolhapur Central Prison Kalamba, Kolhapur submitted that, though Petitioner had filed present Petition for his transfer to Jail in the State of by DNYANESHWAR ASHOK ETHAPE Date:

2023.02.09 14:24:30 +0530 DNYANESHWAR ASHOK ETHAPE Karnataka, subsequently he has changed his mind. The statement of Petitioner has been recorded by the Jail Authority on 05th February 2023. In his statement Petitioner has stated that, as his Appeal is pending before the Hon'ble Supreme Court, presently he has no desire to get transfer in the State of Karnataka. That, he may be transferred to Yerwada Central Prison permanently. Petitioner will be filing appropriate application to that effect with the Jail Authority.

In view of the above, present Petition does not survive and is accordingly disposed off.
