Heard the learned Advocate for the Applicant and the learned APP for the State.

The Applicant, who is arraigned in C.R.No.309 of 2018 registered with Baramati City Police Station for the offences punishable under Sections 302, 143, 147, 148, 149, 323 of the Indian Penal Code, 1860, has preferred this Application for temporary release on bail for one day to appear before the competent authority i.e. the Sub-Divisional Officer, Baramati Division in connection with the proceedings for award of compensation in respect of the land of the Applicant situated at Gut No.223 which is notified for acquisition for the purpose of Sant Tukaram Maharaj Palkhi Marg National High Way No.965-G.

The application is supported by the documents indicating the SSP 1/3
proprietary title of the Applicant over the said land and the notices dated 30th June, 2022 and 8 th July, 2022 issued by the Competent Authority. The latter notice indicates that the hearing is scheduled to be held before the Sub-Divisional Officer, Baramati Division on 20 th July, 2022.

The learned APP, in the aforesaid circumstances, submits that the Applicant can be released on temporary bail subject to certain conditions. 5.
Notices dated 30 th June, 2022 and 8 th July, 2022 reveal that the Applicant, who is shown to be one of the co-owners at Sr. No.1, is summoned to appear before the Competent Authority. In view thereof, the following order is passed :
ORDER
(i) The Application stands allowed.
(ii) The Applicant - Satyawan @ Baglya Kisan Gophane be released on temporary bail from 19 th July, 2022 till 21 st July, 2022 to facilitate him to appear before the competent authority, on furnishing a PR bond in the sum of Rs.15,000/- and one or two sureties in the like amount or cash security in lieu of surety in the said amount to the satisfaction of the learned Additional Sessions Judge, Baramati. (iii) The Applicant shall not contact the first informant or any other prosecution witnesses or shall give any threat or inducement to any of the prosecution witnesses.

(iv) The Applicant shall surrender back to the prison on 21 st July, 2022 by 6.00 p.m.
