Heard learned Counsel for the parties.

Learned Counsel for the respondent has placed on record the order passed by the learned IV Joint Civil Judge, Junior Division, Sangli, dated 7th April 2017 below Exhibit 1 in Regular Darkhast No.165 of 2001 in which the learned Civil Judge has recorded that the dispute between the parties is amicably settled in view of the compromise pursis at Exhibit 52. The order also records that the stay which was granted by this Court in present petition was vacated as per order passed in Civil Application No.1267 of 2016 dated 15th December 2016. Mr.Mankapure, learned Counsel for the respondent, informs that even the possession of the premises has been handed over to the respondent.

The order dated 7th April 2017 along with the documents of compromise are taken on record and marked "X" for identification. The petition is accordingly rendered infructuous in view of the compromise between the parties and subsequent development. It is accordingly disposed of. No costs.
