Ms. Mhatre, learned APP appearing for the respondent/State has tendered across the bar a report of Mr. S. S. Kamble Jail Officer, Class-1, Yerawada Central Prinson, Pune. The same is taken on record and marked ' X'

for identification.

Upon perusal of the contents of the said report, it appears that on 31.05.2022 the petitioner has undergone 19 years 11 months 21 days sentence. It is informed that though the petitioner is released on covid parole, yet he has not surrendered. The grievance raised by the petitioner in writ petition is that the respondent/authority has not considered his prayer to transfer him from Yerawada Central Prison to Open Jail. Ethape

In case, grievance of the petitioner still subsist the concerned authority to consider his prayer/request to transfer him to open prison in accordance with law and keeping in view of other parameters as laid down by State Government. Such a decision shall be taken by the authority as expeditiously as possible however, within four months from today. 4.

In view of above observations, writ petition stands disposed of. 5.
