Heard. This Application is preferred by the Insurance Company for restoration of the Civil Application No.3068/2011 which was dismissed by conditional order dated 18/04/2015.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of Basavraj G Patil 1/2

2444.15-caf prayer clauses (a) to (c) which read thus:

"(a) The delay of 3 days in filing the present Civil Application may kindly be condoned.

(b) This Hon'ble Court may kindly restore Civil Application No.3068/2011 to the file by recalling the order dated 18/04/2015.

(c) This Hon'ble Court may kindly permit the Applicants to serve the notice of Civil Application No.3068, 3067 and 3069 of 2011 on the Respondent No.3 by publication of the notice in the daily newspaper namely Free Press Journal widely circulated in the Maharashtra."

(d) Civil Application stands disposed off accordingly.
