Learned Counsel for the Petitioner has tendered Affidavit-cumundertaking of the Petitioner, wherein he has stated that he shall pay the entire dues of the Respondent-Bank on or before 29th July, 2019, failing which he will hand over possession of the secured asset i.e. flat No. A-403, 4th floor, Pinnacle Residency, Plot No.28, Sector No.35, Kamothe-II, Taluka Panvel, District- Raigad to the Respondent-Bank without protest. Learned Counsel of the Petitioner has handed over a Demand Draft for sum of Rs.4,00,000/- to the learned Counsel for the Respondent-Bank. The balance amount is required to be paid on or before 29th July 2019.

We accept the undertaking of the Petitioner dispose of the Petition.
