DATED : 16th SEPTEMBER 2022 P.C:- On expressing my disinclination to entertain the application, in the wake of the material compiled in the chargesheet, the learned counsel seek permission to withdraw the Bail Application.

Learned counsel is however, perfectly justified in making a statement that he came to be arrested on 7/12/2019 and till date, even charge has not been framed and therefore, trial deserve to be expedited.

2/2 26 BA 2989-21.doc Learned APP state that the case is now scheduled for framing of charge on 22/9/2022 before 66th Metropolitan Magistrate, Court, Andheri, Mumbai.

Considering the long incarceration of the applicant, the Court shall ensure that on the said date, the charge shall be framed. For any reason, if the said step cannot be completed on that day, within a period of one month, thereafter, the charge shall be framed.

On framing of the charge, every endeavour shall be made by the concerned Magistrate to conclude the trial within a period of nine months, since it is informed that there are 15 witnesses to be examined. Liberty is granted to the applicant to renew his request if the trial is not concluded within the stipulated period.
