The Applicants are seeking anticipatory bail in connection with C.R.No.198 of 2019 registered at Akkalkot South Police Station, under sections 307, 143, 147, 504 and 506 r/w. 149 of the Indian Penal Code (for short 'IPC'

).

lodged by one Indubai on 30/04/2019. She has stated that,on 28/04/2019 there was some quarrel between the informant and one Akash Bansode. It appears that Akash had taken offence and was angry with the informant. On 29/04/2019 all the applicants and other accused came to the house of the informant. Akash gave a blow with stick on the informant'

s brother Ravi'

s head. Accused Dashrath assaulted Indubai i.e. first informant on her head. Others assaulted informant'

s father Ningappa and her brother Sanjay.

Others from the informant'

s group were also assaulted. On this basis the F.I.R. was lodged.

Heard Shri. Priyal Sarda, learned counsel for the applicants and Smt. Takalkar, learned APP for the State. 4.

Learned counsel for the applicants submitted that, no specific role is attributed to any of the applicants. No specific weapon is also attributed to them. There are general allegations of assault on the informant'

s group.

Learned APP produced injury certificates before me. Ravi had suffered one simple CLW on his head. Indubai had suffered one simple CLW on her head. Sanjay had suffered two

simple CLWs on his head and Ningappa had suffered one simple CLW on his head. Thus, all the injuries are described as simple injuries. There does not appear to be any offence committed falling within section 307 of IPC. The incident is quite old. The applicants were on interim protection since 21/06/2019. At this stage, their custodial interrogation is absolutely not necessary. They can be protected by an order of anticipatory bail.

Hence, the following order :

ORDER

(i) In the event of their arrest in connection with C.R.No.198 of 2019 registered at Akkalkot South Police Station, the applicants are directed to be released on bail on their furnishing PR bonds in the sum of Rs.25,000/- each (Rupees Twenty Five Thousand each Only) with one or two sureties each in the like amount.

(ii) Application stands disposed of accordingly. (SARANG V. KOTWAL, J.)
