1] This is an application under Section 439 of the Code of Criminal Procedure for bail in C.R. No. I-570 of 2013 registered with Manpada Police Station, District Thane, for the offence punishable under Section 452, 394, 397, 411 read with 34 of the Indian Penal Code. 2] Heard the learned counsel for the applicant and the learned APP. Perused the record of investigation.

3] In the present crime, the applicant has been arrested on 10th February 2014 and since then he is in jail. The record indicates that the 1/2

osk 39-ba-1569-2018.odt applicant is also involved in 17 other crimes of similar nature and is a habitual offender on the record of police. The applicant was granted bail in some other offences and when on bail has committed the present crime. In view thereof, the applicant does not deserve to be released on bail.

4] However, since the applicant is in jail since 10th February 2014, the learned Additional Sessions Judge, Kalyan, is hereby requested to expedite the trial of the applicant i.e. Sessions Case No.125 of 2014 and to make an endeavour to conclude the same on or before 15th December 2019.
