DATED : 15th JULY, 2022 P.C:- My attention is invited to an order passed on 6/7/2022 (ABA No.1630/22) in case of co-accused Abdul Gani Nizamuddin Shaikh.
The complainant, who had appeared through the counsel had placed on record an affidavit where he made a statement to the effect that he has received some amount and some post dated cheques have been handed over to him by the accused persons and therefore, nothing is due and payable to him at the instance of the applicant.

The present applicant also deserve a similar treatment in the wake of the affidavit filed by the complainant which is placed on record at page no.35. Hence, the following order :- : ORDER :
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.595/21 registered with RCF police station, the applicant Abbas Nasrullah Shaikh shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
(c) The applicant shall report to the concerned police station as and when called for.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
