1] By the present appeal the appellant has challenged the Order dated 8th June 2018 passed below Exhibit-54 in Special Civil Suit No.322 of 2015, thereby rejecting the ad-interim relief as prayed for by the appellant. 2] By way of the said application, the appellant-plaintiff had prayed to postpone the Extraordinary General Meeting which was to be held on 11th June 2018 at 11.00 am of M/s. Ajit Scanning and Diagnostic Center Private Limited.

osk 68-ao-480-2018.odt 3] The record indicates that, after the Trial Court rejected the prayer of the appellant by its impugned Order, the said Extraordinary General Meeting was infact held on 11th June 2018 and certain resolutions are passed by the Board of Directors of the said M/s. Ajit Scanning and Diagnostic Center Private Limited.

4] In view thereof, challenge to the impugned Order as of today does not survive. Due to efflux of time present Appeal has become infructuous and is accordingly disposed off.

5] In view of disposal of Appeal, the Civil Application filed therein also does not survive and is accordingly disposed off. [A.S. GADKARI, J.] by Omkar S.
