Heard the learned counsel for the applicant. None appears for the respondent-wife.

By this civil application, the applicant seeks a stay to the effect, operation and implementation of the judgment and decree passed by the Family Court on 05.01.2016, by which the counter claim filed by the respondent-wife for restitution of conjugal rights was decreed.

Since the appeal is admitted and questions of facts as well as law arise the consideration in the same, it would be necessary to stay the effect, operation and implementation of the decree during the pendency of the appeal. Hence, the judgment and decree

Sudhir Rane 12-CA-207-2016.doc passed in favour of the respondent-wife is stayed during the pendency of this appeal.
