Learned counsel for the applicant, upon instructions, fairly submits that the charges are framed in Sessions Case No.24 of 2015 and that two witnesses are examined by the Additional Sessions Judge, Pune. In view of this, it would not be appropriate to consider the application under Section 439 of Cr.PC.. However, the learned Additional Sessions Judge, Pune is requested to make an endeavour to conclude the trial at the earliest and shall not grant any unwarranted adjournments to the State. The application is disposed of.
