Mr.Ponda, learned Senior Advocate for Applicant, on instructions seeks leave to withdraw present application with liberty to participate in Sessions Case No.2300118 of 2015 arising out of C.R No.I-478 of 2015 registered with Virar Police Station, pending on the file of learned Additional Sessions Judge, Vasai, District Palghar. He further submitted that, Applicant is not even desirous to file application u/s.227 of Cr.P.C for discharge and Trial Court may be directed to proceed to frame charge u/s.228 of Cr.P.C and conclude trial as expeditiously as possible.

In view thereof and after taking into consideration the fact that, present case is pending on the file of learned Additional
2 of 2 2.APL.792.2016.doc Sessions Judge for more than seven years, we direct learned Additional Sessions Judge, Vasai seized of Sessions Case No.2300118 of 2015 to expedite the trial of said case and to conclude the same within a period of six months from today.

Criminal Application No.792 of 2016 is disposed off in the aforesaid terms.

Ad-interim relief granted by order dated 2nd December 2016 stands vacated with immediate effect.

In view of disposal of Criminal Application, Interim Application No.1055 of 2020 does not survive and is disposed off. 6.
All the concerned to act on an authenticated copy of this order duly authenticated by Registry of this High Court. 7.
