Heard the learned Counsel for the applicant and Learned APP. After arguing at length, learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. The liberty as prayed for is granted in the interest of justice. However, since there are 53 witnesses to be examined, the learned Magistrate seized with the matter shall make endeavour to complete recording of evidence within one year from the date of receipt of this order.
