The learned APP, at the outset, submitted that the subject crime is investigated and 'A' Summary report is filed in the Court of learned Additional Chief Metropolitan Magistrate, Shivaji Nagar, Pune and notice is issued to the petitioner.

In the light of this, the learned Advocate for the petitioner seeks leave to withdraw the petition with liberty to file Protest Petition in the said 'A' Summary report before the learned Magistrate. 3.

Leave with liberty granted. The petition is disposed off as withdrawn.

It is needless to say that we have not gone into the merits of the matter and all points and contentions of the respective parties are kept open.
