This is an application under Section 438 of the Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R. No.226 of 2023 registered with Jod Bhavi Peth Police Station, Solapur, for the offences punishable under Sections 406 and 420 r/w 34 of the IPC. 2.

In the course of the hearing, learned APP has stated that the notice under Section 41A of the Cr.P.C. could not be served on the Applicant since the Applicant is not residing at the given address. Learned counsel for the Applicant states that the Applicant shall furnish the address within one week. In the light of the said Megha 1/2

25_aba_1838_2023.odt statement, learned APP states that notice will be served to the Applicant on the given address within a period of 10 days. 3.

In the light of the said statement, no coercive action against the Applicant in C.R. No. 226 of 2023 registered with Jod Bhavi Peth Police Station, Solapur, until section 41A notice is served on him. 4.

The application stands disposed of with liberty to the Applicant to file fresh application after service of notice under Section 41A of the Cr.P.C.
