The learned A.P.P., on instructions from the Offcer attached to Aarey Police Station, states that the trial in Sessions Case No.189 of 2015 is in progress and 7 witnesses have been examined till date. She also makes a statement that the prosecution is intending to examin 12 more witnesses. A statement is also made by the learned A.P.P. that the examination of the said witnesses shall be concluded within a M.M.Salgaonkar
2/2 36 BA-1665-20.doc period of six months from today and after completion of evidence, statements of the accused under Section 313 of the Cr.P.C. shall be recorded.

Considering the fact that the applicant came to be arrested on 04/06/2015 and since then he is behind bars, the sessions case deserves an expeditious disposal. The learned Additional Sessions Judge, Dindoshi Court, who is seized of Sessions Case No.189 of 2015, is directed to conduct the trial henceforth on day-to-day basis. A speedy trial is a right conferred upon the accused and pending the trial, he cannot be incarcerated indefnitely. Keeping this in mind, the learned Judge shall expeditiously conclude the proceeding in sessions case and in any case, on or before 31/10/2022. 3.
With the aforesaid direction, the application stands disposed off.
Liberty is granted to the applicant to renew his request, in case trial is not concluded within the stipulated period of time.
