Instant Civil Application is filed by the Applicant/Petitioner regarding report which needs reported to State of Maharashtra about non satisfaction of the order passed by the Hon'ble Court dated 7.8.1998. Learned Counsel for the Applicant pointed out that order dated 7.8.1998 was challenged before the Hon'ble Apex Court. Order dated 7.8.2018 was stayed by the Hon'ble Apex Court. It has pointed out that Hon'ble Apex Court dismissed the Civil Appeal No.1708 of 2001 by order dated 22.09.2010. Leaned Counsel for the Applicant further pointed out that after passing of judgment by the Hon'ble Apex Court, Respondent No.2 had filed Suit No.1627 of 2000 before the Hon'ble Court in its Original Jurisdiction which was dismissed on 30.1.2015. Instant Civil Application is filed on 22.06.2018.

Learned Counsel for the Applicant submitted that application is well within limitation. Considering provision of chapter 17 Rule 22 r/w Rule 23 I am satisfied that application is well within limitation and not barred by any other law. Hence, Civil Application is allowed in terms of prayer clause (a). REGISTRAR (JUDL-I) RJ-I/ARD/23.04.
