This Application is moved for relaxation of condition no. (c) imposed by this Court while granting pre-arrest bail on 7th July, 2015. Condition no. (c) runs as follows:

"The applicant/accused shall not reside or enter the jurisdiction of Nashik city and village Matori for a period of six months except the direction given by this Court for his attendance at Sarkarwada police station."

The learned counsel for the applicant/accused submitted that the applicant/accused is contesting election for membership of Agricultural Produce Market Committee (APMC) and the election is scheduled on 26th July, 2015. So, the learned counsel seeks permission to relax the 1 / 2

906.APPP577_2015.doc condition of entering the village till 6th August, 2015, as applicant's wife is contesting for the post of Sarpanch in Matori Gram Panchayat. 3.

Learned APP opposed the Application.

In view of the submissions made by the learned counsel for the applicant, condition no. (c) is relaxed temporarily as follows: The applicant/accused is allowed to enter the jurisdiction of Nashik city and village Matori from today till 26th July, 2015 upto 6 p.m. and thereafter he shall leave the village and shall not enter till 6th August, 2015. The applicant/accused may enter the Nashik city on 6th August, 2015 at 10 a.m. and attend the Gram Panchayat meeting, vote and then leave the village on the same day at 6 p.m. For the aforesaid period, condition no. (c) is relaxed temporarily. Thereafter, the condition (c) will continue to operate as per the order dated 7th July, 2015.
