Heard learned counsel for the parties.

By this Application, the Applicants seek pre-arrest bail in connection with C. R. No. 1079 of 2017 registered with the Khar Police Station, Mumbai, for the alleged offences punishable under Sections 420, 504, 506 r/w 34 of the Indian Penal Code. 3.

Perused the papers. According to the prosecution, the

parents of the Applicants provided rooms / premises on leave and license basis to the Complainant, despite the fact that they were not the owners of the rooms / premises. It is alleged that the Applicants' parents took huge deposits of Rs. 6,00,000/- from the Complainant - Smt Vinita Salvi. According to the prosecution, when the Complainant went to demand that amount, the Applicants allegedly threatened the Complainant. It is not in dispute that the Applicants' parents were arrested and later enlarged on bail. Prima facie, considering the role of the Applicants and the fact, that the Applicants are students, their custodial interrogation is not warranted. Accordingly, the Application is allowed and the Applicants are granted pre-arrest bail on the following terms & conditions :-

O R D E R

(i) In the event of arrest, the Applicants be enlarged on bail, on executing P. R. Bond in the sum of Rs. 10,000/- each with one or two sureties in the like amount;

(ii) The Applicants shall report to the investigating officer of the concerned police station on 3rd & 4th July, 2019 between 10.00 a. m. and 12.00 noon and thereafter, as & when called

for by the investigating officer;

(iii) The Applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
