By the above Misc. Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant wife seeks transfer of Marriage Petition No.A943 of 2016 filed by the Respondent seeking divorce pending before the Family Court at Bandra to the Family Court at Nashik.

The Applicant has agreed to attend the Court at Bandra if she is paid an amount of Rs.2,000/- towards travel expenses which is a fair suggestion. However, the learned Advocate for the Respondent on instructions states that Rs.2,000/- is a substantial amount and therefore, the Respondent has no objection if the matter is defended by the Applicant from Nashik through video-conferencing. 3.

Since both the parties are educated, keeping in mind, the convenience of both the parties, the following order is passed by consent : ssp 1/2

mca 242 of 2017 (2).sxw (i) The Family Court at Bandra shall conduct the proceedings in Marriage Petition No.A-943 of 2016 through video-conferencing. In the event of any difficulty, the Respondent undertakes to provide to the Court a laptop, WIFI and other equipments necessary to conduct the proceedings through video-conferencing. (ii)The Family Court at Nashik shall allow the Applicant and her Advocate to use the video-conferencing facilities available with the Court to conduct the proceedings in Marriage Petition No.A-943 of 2016 on the dates fixed by the Family Court at Bandra.

(iii)The Family Court at Bandra shall endeavour to dispose off the Marriage Petition No.A-943 of 2016 within a period of six months from the date of this order.

(iv)The parties shall not seek adjournment/s unless absolutely necessary. The Family Court at Bandra shall also not grant adjournment/s to either side unless absolutely necessary.

(v) Since the proceedings shall be conducted through video-conferencing, the Family Court at Bandra shall fix the hearing of the matter at the time specified in advance.
