The consent terms are tendered across the bar. The same are taken on record and marked "X" for identification. The consent terms have been signed by the learned Addl.GP as well as Shri D.R.Nawale, SDO, Panvel for the appellant- State. The consent terms are also signed by the learned counsel for the respondents and one of the respondents i.e. Shri Narayan Gomaji Gharat. The learned counsel for the respondents states that the only surviving respondent i.e. Sunita Hasuram Madhavi will appear before the Registrar (Judicial-I) and sign the consent terms within a period of one month. We accept the said statement.

Hence, we pass the following order:

(i) The appeal and the cross-objection are disposed of in terms of the consent terms;

(ii) A decree/ award shall be drawn in terms of the consent terms only after the deficit court fee on the cross-objection is paid and respondent- Sunita Hasuram Madhavi signs the consent terms; (iii) The appellant will be entitled to refund of court fee on appeal as per rules and the respondents will be entitled to refund of court fee on cross-objection as per rules.
