The learned counsel appearing for the Respondents submits that the Management's presenting officer has been changed. One Mr. Yeshwant Motiram Kamble, Executive Engineer has been appointed now to represent the management. The learned counsel appearing for the Respondents has placed on record a communication received in support of the submissions made before this Court. 2.

The grievance of the Petitioner is that the earlier representative of the management Mr. Shirish Dattatraya Sumant was a law graduate. The Petitioner therefore wanted that he be permitted to engage the services of legally trained person, a lawyer to represent before the Enquiry Officer.

In view of the subsequent development as stated above, the Petition itself becomes infructuous and is disposed of as such. We direct that the enquiry shall be completed within one month from today on its own merits. The Petitioner shall co-operate with the Enquiry Officer.

All issues on merits are kept open.
