P.C.:- This is an Application under Section 438 of the Code of Criminal Procedure for pre-arrest bail in CR No. 573 of 2018 dated 27th May, 2018 registered with Tulinj Police Station, District Palghar under Sections 452, 504, 506 rear with Section 34 of the Indian Penal Code.
Heard the learned counsel for the Applicants and the learned APP. Perused the record.
It is alleged that, on the date and time of the incident, initially the Applicant No.1 came in front of the shop of the Applicant No.1 and used abusive language against the Prime Minister of India. 1/3
ssm 2 The first informant objected to the same. Thereafter, the Applicant No.1 called Applicant No.2 at the said spot and they entered into the shop of the first informant and again the Applicant No.1 used the abusive language against the Prime Minister of India. After taking into consideration the first information report and the record annexed to the Application and the peculiar facts of the present case, this Court is of the considered view that, the custodial interrogation of the Applicants for investigation of the present crime, is not necessary and the Applicants can be protected by pre-arrest bail.
In view of the above, the Applicants can be released on bail.
Hence, the following order.
a) The Applicants be released on bail in CR No. 573 of 2018 registered with Tulinj Police Station, District Palghar on their furnishing PR bond of Rs.25,000/- each with one or two separate solvent local sureties in the like amount.
b) After their release from Jail, the Applicants shall attend the Tulinj Police Station, District Palghar as 2/3
ssm 3 and when called by the Investigating Officer between 11.00 a.m. to 1.00 p.m. upon receipt of a notice under Section 160 of the Code of Criminal Procedure.
c) The Applicants shall not tamper with the evidence and/or pressurize the prosecution witnesses.
