The learned counsel appearing for the Petitioner on instructions seeks permission to withdraw the present Writ Petition with liberty to file appropriate proceedings under Criminal Procedure Court before the learned Magistrate, however, he submits that the learned Magistrate may be directed to decide such proceedings that will be filed by the Petitioner within a stipulated period. Leave granted. The Writ Petition is disposed of as withdrawn with liberty to the Petitioner to invoke the jurisdiction of the learned Magistrate under Section 156(3) of the Criminal Procedure Code. The learned Magistrate is directed to dispose of the proceedings within eight weeks from filing of such proceedings and/or institution of such proceedings. We make it clear that we have not entered upon the contentions on merits raised in the present Writ Petition.
