Learned counsel for the petitioners states that the proposals/representations submitted by the Union representing the petitioners to the Government for granting benefits of time bound promotion/Assured Career Progress Scheme in favour of the petitioners after completing their 12 years qualifying services from the date of their initial appointments for non-teaching staff of aided Ashram school as per Government Resolution dated 30th April 1998 are still pending. Statement is accepted.

Learned counsel for the petitioner states that each of the petitioners would file individual representation/proposal to the concerned Assistant Commissioner for each division within two weeks from today for such relief. Statement is accepted.

Upon receipt of the said representation/ proposal from each of the petitioners, the concerned Assistant Commissioner of the relevant

ppn 2 21-wp-4437.19.doc district would consider such representation on its own merits and in accordance with law and not later than eight weeks from the date of receipt of such representation/proposal. The authority shall take decision itself and not refer the proposal/representation to the Grievance Redressal Committee as sought to be canvassed by the Assistant Commissioner in the affidavit-in-reply filed before this Court. 4.

The order that would be passed by the Assistant Commissioner shall be communicated to the petitioner within one week from the date of passing such order. If the order is adverse against the petitioner, the petitioner would be at liberty to file appropriate proceedings. If the order is in favour of the petitioner, consequential benefits arising out of the said order shall be granted to the petitioners within twelve weeks thereafter.

Writ petition is disposed of in aforesaid terms. No order as to costs. Parties to act on the authenticated copy of this order. ABHAY AHUJA, J.
