Interim Application has been preferred for bringing on record the legal heirs of the deceased Respondent No.3. Learned counsel appearing for the Applicant submits that he had no notice of death of the Respondent No.3 and as such, the Interim Application has been preferred after he acquired the knowledge. He further submits that the Respondent No.3 expired on 14th January, 2016, however, has no notice was given, and the application could not be filed and there is a delay. 1/2

For the reasons stated in the application, the delay, if any is condoned and the abatement is set aside. Interim Application is allowed. Amendment to be carried out within a period of two weeks from today.
