Heard Mr. Ramamurthy, the learned Counsel for the petitioner and Mr. Venegaonkar, the learned Counsel for respondent no.2 and Mr. Saste, the learned APP for the State. 2.

Mr. Ramamurthy, on instructions, seeks leave to withdraw the petition with liberty to fle an appropriate proceeding before the learned Magistrate, who is seized with the matter. 3.

Mr. Ramamurthy undertakes to fle such application within a period of four weeks from today.

The petition stands dismissed as withdrawn with liberty as prayed for.

In the event, such application is fled within the aforesaid 1/2
